RESUMEN

La presente investigación aborda el tema de las insuficiencias funcionales en la organización administrativa de los órganos locales del Poder Popular en los municipios: una visión desde la Constitución de la República, persiguiendo como objetivo general fundamentar las insuficiencias funcionales de los órganos locales del Poder Popular en los municipios. Como objetivos específicos nos proponemos los siguientes: analizar en el plano teórico-histórico la organización administrativa de los órganos locales municipales del Poder Popular a partir del estudio de este elemento en la Constitución de la República y el Estado cubanos, valorar partiendo del estudio de cada uno de los cuerpos constitucionales que han regido en Cuba, la evolución experimentada por la organización administrativa y la trascendencia jurídica de la Constitución de 1976 con su reforma en el ámbito de la organización administrativa municipal y explicar las insuficiencias en el funcionamiento de la organización administrativa municipal. Asimismo utilizamos los siguientes métodos: método teórico jurídico, método de análisis histórico, el de estudio comparado y el exegético analítico, aplicando como técnicas el análisis bibliográfico, la entrevista y la encuesta. El trabajo consta de dos capítulos, el primero titulado “Constitución, Estado y Administración: visión histórica doctrinal y de estudio comparado”, donde pretendemos dejar sentadas las categorías en torno a las cuales se mueve la organización administrativa y un segundo capítulo que lleva por nombre “La organización administrativa de los municipios en la Constitución de 1976”, a partir del cual se realiza un análisis de esta institución en el ámbito local municipal tomando como base a la Constitución y otras normativas derivadas de ella teniendo como resultado las insuficiencias en el funcionamiento de esta institución y las propuestas para su erradicación.

SUMMARY

This research addresses the issue of functional deficiencies in the administrative organization of local organs of Popular Power in municipalities: a view from the Constitution of the Republic, seeking to substantiate the general objective functional inadequacies of the local organs of People's Power municipalities. The specific objectives we propose the following: to analyze the theoretical and historical administrative organization of local municipal bodies of the People from the study of this element in the Constitution of the Republic and the Cuban state, value from the study of each one of the constitutional bodies that have governed in Cuba, the evolution of the administrative and legal significance of the 1976 Constitution with reforms in the local administrative organization, explain the shortcomings in the functioning of local administrative organization. We also use the following methods: Method legal theory, method of historical analysis of comparative study and exegetical analytical techniques applied as literature analysis, interviews and the survey. The work consists of two chapters, the first entitled "Constitution, State and Management: historical overview and comparative study of doctrine", where we aim to lay down the categories around which moves the administrative organization and another section that is called "The administrative organization of the municipalities in the 1976 Constitution," from which an analysis of this institution in the local area municipal basis to the Constitution and other legislation arising from it resulting in deficiencies in the operation of this institution and the proposals for its eradication.
